Montesquieu ve kuvvetler ayrılığı ilkesi

Abstract

Montesquieu, Fransız monarşisinin güçlü bir eleştirmenidir. O, iktidarın yetkilerinin, monarşide olduğu gibi tek bir elden yönetilmek yerine yasama, yürütme ve yargı organları arasında bölünmesi gerektiğini savunmuştur. Bu çalışmada Montesquieu'nün Kanunların Ruhu isimli eserinde ele aldığı kuvvetler ayrılığına ilişkin görüşleri analiz edilerek felsefi açıdan değerlendirilmeye çalışılmış, bu konudaki fikirlerinin onun genel siyaset felsefesi içindeki merkezi konumu ortaya koyulmaya çalışılmıştır.

Montesquieu was an influential critic of French monarchy. He argued for the necessity of separation of the authority powers into legislation, execution and jurisdiction rather than being ruled by a single authority, which is similar to monarchy. In this study, the views of Montesquieu regarding the separation of Powers in his book titled the Spirit of Rules were analyzed, then were evaluated from a philosophical perspective. Lastly we attempted to indicate the centrality of his separation principle within the general political philosophy on the grounds of his views.
